اَلسَّلَامُ عَلَیّکُمٌ وَرَحٔمَتُہ اللهِ وَبَرَکَاتَه

MAAL-E-TIJAARAT PAR ZAKAAT !!

 ﺑِﺴْـــــــــــــﻢِﷲِﺍﻟﺮَّﺣْﻤَﻦِﺍلرَّﺣِﻴﻢ

MAAL e tijaarat nisaab (saadhe baawan tole Chandi ki keemat) Ko pahuch jaye aur is par saal guzar jaye to ZAKAAT farz hai, is par Qur'an majeed,ijmaa e ummat,aur sahaaba was tabayeen ke aqwaal Daleel hain,

QUR'ANI DALAIL :-

1:- ALLAH ﷻ  ka Farmaan hai :-

Ahle Imaam apni kamai me se ( allah ﷻ ki raah me ) kharch karo.

Surah Al baqarah :- 267.

Imaam mujaahid bin jabr Rh bayaan karte hain :- is ayat se muraad tijaarat hai.

Tafseer e tabri jild 4 safa 695.

2:- ALLAH ﷻ ka Farmaan hai :-

Un ke amwaal (MAAL e tijaarat) se ZAKAAT ada kijiye.

Surah tauba :- 103.

3:- FARMAAN E BAARI TAL'A HAI :-

In ke amwaal me (ghareeb wa masakeen ka)muqarrar Haq hai.

Surah ma'arij 24.

Is ayat e mubarka me MAAL aam hai saamaan e tijaarat bhi Shamil hai.

AHADEES E RASOOL ﷺ  se dalail:-

1:- Abu hurerah r.a bayaan karte hain ke Rasool Allah ﷺ  ne Khalid bin Waleed r.a ke bare me farmaya:-

Khalid (r.a) ne apni zirah aur jangali saaz o saman Ko allah ﷻ  ki raah me waqf kar diya hai.

Saheh bukhari,1468 muslim, 983.

Is hadees ki Sharath me Imaam nawwi Rh likhte hain :-

Ba'az ahle ilm ne is hadees se maal e tijaarat par zakaat ke wajoob par istidlaal Kiya hai, salaf wa Khalaf me jamhoor ka ahle ilm ka yahi mazhab hai.(end quote).

Sharah nawwi, jild 7 safa 56.

Jab amaal ne Khalid bin Waleed r.a se alaat Harb Ko saamaan e tijaarat samajhte hue zakaat ka mutalba Kiya to nabi ﷺ  ne unhe Bataya ke ye saamaan  raah e khuda me waqf hai, saaamaan e tijaarat nahi, matlab  ye ke agar wo saamaan e tijaarat hota to ZAKAAT ka mutalba durust tha.

2:- qais Bin ABI gharza r.a bayaan karte hain ke Rasool Allah ﷺ ne farmaya:-

Taajiro bilashuba khareed o farokht me laghu bat aur (jhoothi)Kasam Dakhil ho jati hai,lihaaza Ise sadqe ke zariye se paak karo.

Sunan Abu Dawood, 3326, nisai,3800,tirmizi,1208,ibne Maja, 2145.

Is ki beshumaar isnaad hain aimma aimma e hadees ne is ki tasheeh ki hai.

Ma'az bin Jabal r.a Ko yaman ki taraf bheja Gaya to farmaya :-
Ahle yaman Ko khabar Dena allah ﷻ ne un par un ke Malo me zakaat farz ki hai, jo in ke ameero se li jayegi aur ghareebo taqseem ki jayegi.

Saheh Bukhari,1395,muslim,19.

SAAMAAN E TIJAARAT MAAL HAI IS HADEES KE UMOOM ME DAKHIL HAI.

IJMAA'

1:-Imaam Qasim bin Salaam Rh ( 224 hijri)farmate hain :-

MUSALMANO ka IJMAA' hai ke MAAL e tijaarat me zakaat farz wajib hai, is ke bar khilaaf 1 qaul hai Jo hamare ilm ke mutaabik ahle ilm me se kisi ka bhi qaul nahi.

Al amwaal, 1202.

2:- IMAAM IBNE MANZAR RH (319 hijri) FARMATE HAIN :-

Ahle ilm ka IJMAA' hai ke MAAL e tijaarat par agar 1 saal guzar jaye to us par zakaat hai.

Al IJMAA',safa 115, al majmoo' sharah mazhab li nawwi,jild 6 safa 47.

ASAAR E SAHAABA WA MUHADDISEEN:-

(1) ABDULLAH BIN UMAR R.A BAYAAN KARTE HAIN:-

SAAMAAN e Tijaraat ke ilaawa saamaan par zakat nahi.

Sunan kubra lil baihaqi jild 4 safa 174.

Imaam nawwi aur Imaam ibne Hajar Rh ne is  qaul Ko saheh kaha hai.

Ye qaul zikr karne ke Baad imaam baihaqi farmate hain:- aksar ahle ilm ka yahi Mazhab hai.

(2) imam umar bin abdul azeez rehmatullah ne zarik bin hayaan rehmatullah ko khat likha:-


musalmaano ke tijaarati saamaam me har chaalis dinar par ek dinar zakaat wasool kijiye.

( muwatta al imam malik 1/255 sanad saheh)


(3) imam ata bin abi rabaah rehmatullah farmate hain:-

moti, zabar jad, ya kuwat, fusoos, samaan aur jis chiz ki tijarat na ki jaye, me zakaat nhi. samaan tijarat ki keemat farokht par zakaat hai.


( musanaf ibne abi shaiba 3/144 sanad saheh).

naiz aap rehmatullah se sawal hua:-


ek Tajir ke paas kai isnaaf ka kaseer maal hai, us ki zakaat ka waqt agaya hai, kya wo andaze se maal ki keemat tai karke zakat ada kar de? farmaya nahin, balki wo sone(gold) aur chaandi ki zakaat sone chaandi se hi de aur tijaarati maal ki zakaat us waqt de jab use farokht kare.


(al amwaal al ibne zanjoweya 1703.sanad saheh)

jis din zakaat farz ho, us din samaan ki muhaat andaza se keemat lagaiye ga, us ki adaigi usi waqt bhi ho sakti hai aur maal ke farokht karne par bhi.


(4) imaam memoon bin mehraan rehmatullah farmate hain:-

jab samaan par zakaat ka waqt agaya( ya'ni saal pura ho gaya) to aap ke paas jo bhi nakad ya samaan tijaarat maujood hai us ki keemat ka nakdi ki surat me andaza lagayein, jo karz hai usey shumar kijiye, phir ussey karz ko nikal dijiye aur baki maal par zakaat ada kar den.

(5) faqhiya jabir bin zaid Rahmatulla farmate hain:-

apne samaan ki us din ki keemat ke mutabik takhmeena lagaiye, jis din zakaat farz hovi hai phir us par zakaat ada kar dijiye.

(al amwaal al qasim bin salam 1182 sanad hasan).
